1. Introduction

Welcome to Workmustra (“we,” “us,” “our,” or the “Company”). These Terms of Service (“Terms”) govern your access to and use of the Workmustra mobile application, website, and related services (collectively, the “Service”) provided by Workmustra.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


2. Definitions

  • “Account Owner” means any individual or entity that registers an account with Workmustra and administers the account.
  • “Worker” means any employee, contractor, or individual whose information is managed through the Service by an Account Owner.
  • “User” means any individual who accesses or uses the Service, including Account Owners and Workers.
  • “Content” means all data, information, documents, and materials uploaded, stored, or processed through the Service.
  • “Subscription” means a paid plan that allows access to premium features of the Service.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

  1. You have the legal capacity to enter into a binding agreement.
  2. You are not located in a country that is subject to a U.S. government embargo.
  3. You are not on any list of prohibited or restricted parties.

4. Account Registration

4.1 Account Owner Responsibilities

As an Account Owner, you:

  • Must provide accurate, complete, and current information during registration.
  • Are solely responsible for maintaining the confidentiality of your login credentials.
  • Are responsible for all activities that occur under your account.
  • Must immediately notify us of any unauthorized use of your account.

4.2 Worker Data

By adding Workers to your account, you:

  • Represent and warrant that you have obtained all necessary consents from Workers to store and process their personal data through the Service.
  • Are responsible for the accuracy and completeness of all Worker data entered.
  • Understand that Workers may have rights to access their data under applicable laws.

5. Services Provided

Workmustra offers the following core services:

  1. Worker Management: The ability to create, store, update, and manage worker profiles including name, phone number, email address, and other personal information.
  2. Attendance Tracking: The ability to record daily attendance for workers.
  3. Salary Calculation: Automated calculation of monthly salaries based on attendance records and other configurable parameters.
  4. Document Management (Future Feature): Storage of worker documents, banking information, and other sensitive data.
  5. Subscription Plans: Access to additional features based on the selected subscription tier.

6. Data Privacy and Protection

6.1 Data You Provide

All data you enter into Workmustra is owned by you (the Account Owner). You retain all rights to your Content.

6.2 Our Role

We act as a data processor on your behalf. We process and store data only as necessary to provide the Service.

6.3 Data Security

We implement reasonable security measures to protect your data, including:

  • Encryption of data in transit (SSL/TLS).
  • Secure data storage with access controls.
  • Regular security reviews and updates.

However, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

6.4 GDPR and Privacy Laws

We are committed to complying with applicable data protection laws, including:

  • The General Data Protection Regulation (GDPR) for users in the European Economic Area (EEA).
  • The California Consumer Privacy Act (CCPA) for users in California.

  • Providing Workers with appropriate privacy notices.

7. Acceptable Use Policy

You agree NOT to:

  1. Use the Service for any unlawful or fraudulent purpose.
  2. Infringe upon the intellectual property rights of others.
  3. Upload, store, or transmit any harmful, defamatory, or offensive content.
  4. Attempt to gain unauthorized access to the Service or its related systems.
  5. Interfere with or disrupt the Service or its infrastructure.
  6. Use the Service to violate any applicable laws or regulations.
  7. Reverse engineer, decompile, or disassemble any part of the Service.
  8. Use automated systems (e.g., bots, scrapers) to access the Service.

8. Subscription and Billing

8.1 Subscription Plans

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. No refunds will be issued for partial billing periods.

All intellectual property rights in the Service, including but not limited to:

  • The software, code, and algorithms.
  • The design, layout, and user interface.
  • The “Workmustra” name, logo, and trademarks.

Are owned by Workmustra. You are granted a limited, revocable, non-exclusive license to use the Service for your business purposes.

9.2 Your IP

You retain ownership of all Content you upload, store, or process through the Service. You grant us a license to use your Content only as necessary to provide the Service.

9.3 No Ownership Transfer

Nothing in these Terms transfers ownership of any intellectual property from either party to the other.


10. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose.

  • Uninterrupted or error-free operation.

10.2 Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • We are not liable for any loss of profits, revenue, data, or goodwill.
  • Our total liability to you shall not exceed the amount paid by you for the Service in the past 12 months.

10.3 HR and Payroll Accuracy

IMPORTANT: Workmustra provides tools to assist with attendance tracking and salary calculation. However:

  • We do not guarantee the accuracy of salary calculations.
  • You are solely responsible for verifying payroll calculations.
  • We are not liable for any payroll errors, overpayments, or underpayments.
  • We recommend you always independently verify payroll calculations.

10.4 Legal Compliance

IMPORTANT: Workmustra does not provide legal, financial, or professional advice. You are solely responsible for:

  • Ensuring your use of the Service complies with all applicable laws, regulations, and employment standards.
  • Maintaining proper records and documentation for legal and tax purposes.
  • Complying with employment laws, tax laws, and data protection laws.

11. Indemnification

You agree to indemnify, defend, and hold harmless Workmustra and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  1. Your use of the Service.
  2. Your violation of these Terms.
  3. Your violation of any third-party rights.
  4. Any Content you submit or store through the Service.
  5. Your violation of applicable laws or regulations.

12. Data Retention and Termination

12.1 Termination by You

You may close your account at any time through your account settings.

12.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • We are required to do so by law.
  • We suspect fraudulent or harmful activity.
